Foreign National working in India for last 10 years. Will he be treated as Resident or a Non- Resident?

A query: A foreign national (Germany) residing in India for last 20 years.. He has been working in India with an Indian company and has retired now and settled in India.. Married to an Indian Resident… As per KYC he has NRI status and his bank account too are NRO and NRE account… We are opening investment account so had a query on his status.. is the status correct,,he has been filing ITR on based of the mentioned status.

For investment purposes the residency status has to be reckoned under FEMA. Since he has been working in India for past 10 years, he will be a “person resident in India” for FEMA purposes.
